Recall Petitions Dismissed

Tough day for Kent School District families. Judge Michael Scott dismissed the Recall Petitions against KSD Board Directors Meghin Margel & Tim Clark on April 11, 2025—ruling our evidence insufficient.

 

Petitioners were not able to introduce evidence of the “on-going litigation”—the new evidence being that Petitioner Greta Nelson had learned of a CR2A settlement agreement in the Resolution 1669 litigation on March 28, 2025, because her name was listed as a signer on the document—and she declined to sign it because her case was dismissed on October 2, 2024 and was not appealed. (Related note: Director Cook was not made whole by the settlement, which he chose to take in the best interests of the Public, rather than his own.)

We know Margel’s and Clark’s individual actions have hurt our District (and Director Cook). Petitioners are fine-tuning the arguments—we’ll either appeal the Order to the Supreme Court, or re-file a new Petition against Margel that includes the new facts. Since it is an election year for Tim Clark, a recall petition would not be allowed to move forward against him if re-filed given the timing before the next general election for his Board position.

Respondents' Motion to Continue, 3/14/25

On Friday, March 14, Attorneys Duncan Fobes, Karen Griffith, and Casey Schaub of Patterson Buchanan Fobes & Leitch, Inc., P.S. entered their appearances on behalf of Respondents Margel and Clark in the recall action. Counsel also filed a Motion to Continue Briefing Schedule and Sufficiency Hearing with a request for the motion to be heard on shortened time (for Monday, March 17)—and emailed the Bailiff requesting a telephone conference with the Judge so that an expedited decision could be made. The Proposed Order submitted with the Motion requested an extension for the briefing schedule from March 19 to April 18, and for the sufficiency hearing from March 24 to April 23.   


Petitioners drafted a Response in Opposition and filed and served it Sunday, March 16. Judge Scott did not schedule a conference call with the parties and instead entered an Order (on March 17) granting a continuance to April 7 for any answer/briefing of the parties, and April 11 at 10:00 a.m. for the sufficiency hearing.

February 5, 2025:  Recall Petitioners first submitted a combined Recall Petition for three Board Directors of Kent School District No. 415 (Meghin Margel, Tim Clark, and former Director Awale Farah).


February 13, 2025:  The King County Prosecuting Attorney's Office rejected the combined Recall Petition due to it not being individualized per Board Director (separate petitions are needed for each Director being recalled), and since Director Farah had stepped down from the Board on December 13, 2024, he is no longer an officer able to be recalled. At the time of the original submission, Director Farah could have been reinstated to his Board position (which at that time hadn't yet been filled), so he was included for good measure (as he is just as responsible for the acts complained of as the other two charged in this effort).


February 25, 2025:  After a bit of editing work and adding additional (very important) detail missing from the first version, Recall Petitioners re-submitted two separate Recall Petitions - one for Board President Meghin Margel (District 2), and another for Legislative Representative Tim Clark (District 5).
